Copyright infringement: use of material that's not yours, I.e the picture. Saying that you don't own the material doesn't prevent copyright infringement either, the only way one can use copyrighted material legally is by paying royalties to the copyright holders. And don't tell me I'm wrong because they teach us this on my media course in college, at the young age of 17 I already forgotten more about copyright law than most people on this site will ever know.
So everyone on Deviantart that draws FANART of anything should be sued for copyright infringement because they don't pay royalties? If any company ever really had a problem with this I'm sure Deviantart would be taken down already. As far as I know fanart isn't illegal, taking someone else's idea and claiming it's your own is and it's worse if someone is making money of another idea. Fanart isn't copyright infringing if it's stated they don't own the idea they based their "art" from. That's like saying, someone who created a masterpiece statue inspired and based on a famous painting should be sued even if they told the rest of the world where the idea came from.

So drawing over copied and pasted official images (CMC as 3MB), stretching them out of shape (Rainbow Dash in "Blue Screen Ponies") and cutting parts of limbs off to fit into your pictures isn't "Alterations" to the original images? Alter means to change something and you've changed some MLP images. "For copyright protection to attach to a later, allegedly derivative work, it must display some originality of its own." None of your art contains any originality of it's own (except maybe the Sonic look-a-like with the exact name from a villain in Harry Potter) unfortunately names aren't included in copyright laws, so your unoriginal name is protected. I guess though, even if both of you are guilty of Copyright Infringement and have unauthorized derivative works you can both use the defense of "Fair Use". At least RenePolumorfous doesn't even need to use official artwork to make her art look good, she's only using it as a background so other people know what a Suicune is AND she already said "The background pictures are officialy made by Nintendo/Pokemon Crystal version (c)". So, she isn't even claiming it as her own, you have not even credited Hasbro for the majority of all your MLP pictures.
